A South Dakota judge has struck down a voter-approved constitutional amendment that legalized the use of small amounts of marijuana for recreational purposes.
Circuit Court Judge Christina Klinger ruled the measure violated the state’s requirement that constitutional amendments deal with just one subject. The amendment received around 54 percent of South Dakota voter approval in November’s general election.
